Welcome to Incador. The terms “we”, “us” and “our” refer to Incador. We operate this website and online store, including all information, content, features, tools, products and services (collectively, the “Services”), to give you a curated shopping experience. Incador is powered by Shopify, which enables us to provide the Services.
By visiting, interacting with or using the Services, you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree, please do not use the Services.
1 Access and account
You confirm that you are at least eighteen (18) years old (or the age of majority in your jurisdiction) and that any minor dependants using the Services on your devices have your consent.
You agree that all information you provide is true, current and complete and that you have the right to provide it. You are responsible for safeguarding your account credentials and for all activity under your account.
2 Our products
We have made every effort to display our products accurately, but colours and appearance may vary depending on your device settings.
All descriptions, prices and availability are subject to change without notice. We may discontinue or limit any product at our discretion.
Every Incador piece is handcrafted to order, so change‑of‑mind returns are not offered.
Your statutory rights concerning faulty items are unaffected (see Section 3).
3 Orders
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. Acceptance occurs only when we send a confirmation email after receiving and processing payment. Please review your order carefully before submitting; we may not be able to cancel once accepted.
If we change or cancel an order, we shall attempt to contact you using the details provided.
Purchases are for personal or household use only and not for resale. Faulty or damaged items may be returned or replaced in accordance with our Returns Policy.
4 Prices and billing
Prices are shown in pounds sterling (GBP) and include VAT unless stated otherwise. Shipping, customs and import charges are additional.
The price in force at the time of order is the price in your confirmation email. Promotions may have separate terms; where those conflict with these Terms, the promotion terms apply.
You agree to keep your payment information up to date and warrant that you are authorised to use the chosen payment method.
5 Shipping and delivery
All delivery dates are estimates. We are not liable for delays caused by carriers, customs processes or events outside our control.
Risk and title remain with Incador until the goods come into your physical possession or that of a person you nominate (other than the carrier).
6 Intellectual property
All content on the Services is owned by Incador, its affiliates or licensors and is protected by United Kingdom and overseas intellectual‑property laws. You may use the Services for personal, non‑commercial purposes only. No rights are granted except as expressly set out in these Terms.
7 Optional tools
We may provide access to third‑party tools “as is” and “as available”, without warranties. You use such tools at your own risk and should familiarise yourself with the relevant third‑party terms.
8 Third‑party links
The Services may contain links to third‑party sites. We are not responsible for the content or accuracy of those sites and accept no liability for any loss arising from your use of them.
9 Relationship with Shopify
Incador is powered by Shopify. Your contract of sale is with Incador, and Shopify is not responsible for any part of that sale. You expressly release Shopify from all claims arising out of your transactions with Incador.
10 Privacy policy
Personal information is handled in line with our Privacy Policy and Shopify’s privacy policy. By using the Services you acknowledge both policies.
11 Feedback
If you provide ideas, reviews or other content (“Feedback”), you grant us a worldwide, perpetual, royalty‑free licence to use, modify and publish that Feedback. You warrant that you own or control all rights in the Feedback and that it does not infringe any third‑party rights.
12 Errors, inaccuracies and omissions
We may correct errors or omissions in the Services and cancel orders affected by such inaccuracies at any time without notice.
13 Prohibited uses
You may use the Services only for lawful purposes. Activities such as infringing intellectual‑property rights, transmitting malware, spamming, scraping or any conduct that harms Incador, Shopify or other users are prohibited. We may suspend or terminate your account without notice for violations.
14 Termination
We may terminate your access to the Services at any time. Sections concerning intellectual property, Feedback, termination, disclaimers, limitation of liability, indemnity, severability, waiver, entire agreement, assignment and governing law survive termination.
15 Disclaimer of warranties
Except as expressly stated, the Services and all products are provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Services will be uninterrupted, timely, secure or error‑free.
16 Limitation of liability
To the fullest extent permitted by law, Incador, Shopify and our respective officers, employees and agents shall not be liable for indirect, incidental or consequential damages arising from your use of the Services or products.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot be limited or excluded under applicable law.
17 Indemnification
You agree to indemnify and hold harmless Incador, Shopify and our affiliates against any losses arising from your breach of these Terms or your misuse of the Services, including reasonable legal fees.
18 Severability
If any provision is found unlawful or unenforceable, it shall be severed to the extent necessary and the remainder of the Terms shall continue in force.
19 Waiver; entire agreement
Failure to enforce any right or provision shall not constitute a waiver. These Terms and any policies referenced herein form the entire agreement between you and Incador.
20 Assignment
You may not assign your rights under these Terms without our written consent. We may assign or transfer our rights and obligations without notice.
21 Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
22 Headings
Headings are for convenience only and do not affect interpretation.
23 Changes to these Terms
We may update these Terms at any time. Material changes will be notified in accordance with applicable law and take effect on the date specified. Continued use of the Services after changes constitutes acceptance of the revised Terms.
